PEMBERHENTIAN PNS TERKAIT KORUPSI PERSPEKTIF UU No. 30 TAHUN 2014 TENTANG ADMINISTRASI NEGARA

Abstract

Punishment of PNS related corruption in accordance with the Act No.30 of 2014 on State Administration.His problem is how the termination of the PNS related corruption perspective of the Act No. 30 of 2014 on state administration.The purpose of this study is to analyze the regulations concerning the dismissal of civil state officials in the inappropriate local government.The method of research used is the method of normative research which examines the primary legal material of legislative regulations concerning the termination of PNS related corruption. The study aims to study the provisions of Act No. 30 using document analysis techniques. 30/2014 and the impact of its implementation on local officials. According to the findings, the Act No. 30 of 2014 regulates various aspects related to the dismissal of civilian state officials (PNS), such as the legitimate reasons for the termination, the procedures to be followed, and the rights of workers in the process. The law also empowers the local government to fire workers in accordance with the rules in force in Indonesia. Implementation of Act No. 30 of 2014 has not been smooth throughout the region, and there are challenges in the implementation of the provisions. While some state officials may be worried about their dismissal, the local government must ensure that the dismissals process is legal and fair. This study highlights the importance of knowing the Law No. 30 of 2014 concerning dismissal of staff in the local government sector. In addition, the study also prompted further discussions on efforts to improve the enforcement and justice of termination of employment relations (PHK) in the region.

Pemberhenntian PNS terkait  korupsi sesuai dengan UU No.30 Tahun 2014 tentang administrasi negara. Permasalahan nya adalah bagaimana pemberhentian PNS terkait korupsi perspektif UU No. 30 Tahun 2014 tentang administrasi negara.Tujuan dari penelitian ini adalah untuk menganalisis peraturan mengenai pemberhentian pegawai negeri sipil pada pemerintah daerah yang tidak sesuai.Metode penelitian yang digunakan adalah metode penelitian normatif yaitu meneliti bahan hukum primer berupa peraturan perundang-undangan mengenai dengan pemberhentian PNS terkait korupsi. Penelitian ini bertujuan mengkaji ketentuan mengenai UU No. 30 dengan menggunakan teknik analisis dokumen. 30/2014 dan dampak implementasinya terhadap pejabat daerah. Dari temuan tersebut, UU Nomor 30 Tahun 2014 mengatur berbagai aspek terkait pemberhentian pegawai negeri sipil (PNS), seperti alasan sah pemberhentian, tata cara yang harus dilakukan, dan hak-hak pekerja dalam prosesnya. Undang-undang tersebut juga memberikan wewenang kepada pemerintah daerah untuk memecat pekerja sesuai dengan peraturan yang berlaku di Indonesia. Implementasi UU Nomor 30 Tahun 2014 belum berjalan mulus di seluruh daerah, dan terdapat tantangan dalam penerapan ketentuan tersebut. Meskipun beberapa pegawai negeri mungkin merasa khawatir mengenai pemecatan mereka, pemerintah daerah harus memastikan bahwa proses pemecatan tersebut harus sah dan adil. Kajian ini menyoroti tentang pentingnya mengenal Undang-undang Nomor 30 Tahun 2014 terkait pemberhentian pegawai di sektor pemerintah daerah. Selain itu, studi ini juga mendorong diskusi lebih lanjut mengenai upaya meningkatkan pelaksanaan dan keadilan pemutusan hubungan kerja (PHK) di daerah.
